ACT wants Parliament, not courts, deciding when tikanga applies in law

ACT has proposed barring courts from relying on tikanga — Māori customary values and practices — unless Parliament has expressly allowed it. Leader David Seymour said the Supreme Court's 2022 Ellis decision expanded tikanga's legal role beyond what Parliament intended. The policy would shift interpretive authority over tikanga's place in law from the judiciary to Parliament.
