ACT proposes barring courts from relying on tikanga unless Parliament allows

ACT has proposed restricting courts from considering Māori tikanga in decisions except where Parliament has expressly allowed it. Party leader David Seymour said the Supreme Court's Ellis decision expanded tikanga's role beyond what Parliament legislated. The policy would shift interpretive authority over tikanga's place in law from the judiciary to Parliament.
