Justice Samuel Alito will not take part in Boulder, Colorado's climate case against ExxonMobil and Suncor Energy, the court said in a letter Sept. 28, 2026, days before oral arguments, when lawyers argue in person. No reason was given. The lawsuit claims the fossil-fuel companies misled the public about climate change.
