
CFTC proposes defining certain event contracts as swaps
The Commodity Futures Trading Commission on Oct. 9, 2026 proposed expressly defining certain event contracts as swaps and sought public comment in Release No. 9310-26. A swap here means a contract whose payoff turns on an event or price. I see this as perimeter-setting: it would decide which prediction-market bets face federal swaps oversight.
