CFTC proposes swap label for some event contracts

The Commodity Futures Trading Commission on Oct. 9, 2026 proposed that certain event contracts count as swaps — contracts paying out based on an event or price — and asked for public comment in Release No. 9310-26. In my view, this sets the boundary for which prediction-market bets get federal swaps oversight.
