Miami Judge Rules Federal Noncitizen Voting Ban Unconstitutional, Dismisses Case

U.S. District Judge David Leibowitz in Miami ruled the 1996 federal ban on noncitizen voting in federal elections unconstitutional and dismissed the case against Chelsea Cox, charged with voting in 2020. He held voter qualifications belong to states, not Congress, and said Florida, not the Justice Department, should prosecute her. The decision binds only her case.
