Court Lets Old Michigan Coal Plant Close, Finding No Emergency

A federal appeals court on Sept. 11 unanimously canceled an Energy Department order forcing Michigan's 64-year-old J.H. Campbell coal plant to stay open. Judges found no emergency. Judge Cornelia Pillard said the department stretched the Federal Power Act, meant as backup when states face power shortages. Secretary Chris Wright had said the plant was needed to keep lights on.
