Court voids U.S. emergency order to keep Michigan coal plant open

The D.C. Circuit unanimously vacated the Energy Department's order keeping Michigan's 64-year-old J.H. Campbell plant open, ruling Sept. 11 that no emergency justified it. Judge Cornelia Pillard wrote the department exceeded Federal Power Act authority, a narrow backstop for immediate crises states cannot solve. Secretary Chris Wright had cited grid reliability.
