First Circuit Upholds Ruling That DHS Third-Country Removal Policy Is Unlawful

A 1st Circuit panel on Sept. 19 upheld a February ruling that DHS's March 2025 third-country removal policy is unlawful. Judge Seth Aframe said migrants need a "meaningful" chance to raise safety fears before deportation to a country where they lack citizenship. Minimal notice plus diplomatic assurances alone is insufficient.
