UK Court of Appeal to Set Boundaries on Judicial Review of Terrorism Proscriptions

A pending Court of Appeal ruling on whether Palestine Action can lawfully be designated a terrorist organisation will establish how rigorously British courts scrutinise government counter-terrorism designations. The High Court ruled the proscription unlawful in February 2026; the Home Office appealed in April. The outcome will determine whether ministers retain broad discretion to ban organisations or whether courts can compel substantive review of the statutory criteria defining terrorism itself.
